Stages of a Social Security Disability Claim
You deserve government benefits when you are no longer able to work.    But you have to demand those benefits!
  1. Claim is Approved (END)
    Your claim is approved by the SSA. You get a lump-sum payment and monthly payments.
  2. Denial
    They say you are not disabled. You have 60 days to Request Reconsideration.
  3. Request for Reconsideration
    SSA is wrong. I am disabled, and I can prove it.
  4. Denial
    You can now ask for a hearing before an Administrative Law Judge (ALJ). You have 60 days.
  5. Initial Application
    You apply: (1) online; (2) in person; or (3) by phone.
  6. Hearing
    You appear before an ALJ for a hearing.
  7. IF CLAIM IS DENIED . . . . .
    APPEALS COUNCIL You ask the Appeals Council to review the case.
  8. FURTHER DENIAL
    The Appeals Council reviews it and denies the claim.
  9. Federal District Court
    Your case has to be filed in Federal District Court just as any civil case filed in a federal court.
  10. Rehearing at ALJ
    The Federal District Court sends the case back to the hearing level for a new hearing.
